Update and Changes on Effective Date for Products Containing Mercury Proposed Regulatory Amendment

October 17, 2023

Mercury Proposed Regulatory Amendment
EFC has previously sent out communications regarding a proposed amendment to the Products Containing Mercury Regulation.

Canada Gazette, Part I, Volume 156, Number 52: Regulations Amending the Products Containing Mercury Regulations

The proposed regulation would impact the sale of lighting that contains mercury. EFC’s Lighting Business Section (Lighting Manufacturers) provided written comments during the public consultation phase, and at the request of the Ministry, lighting manufacturers had a meeting with the Environment & Climate Change Canada (ECCC).   The revised regulation has not been published, and stakeholders have expressed concern that December 31, 2023 is the proposed effective date of the amendment.

Electro Federation Canada sought confirmation of the implementation date with the Ministry of Environment and Climate Change Canada and was informed that December 31, 2023, will not be the effective date for the amended regulations.  The final amendments will be published in the Canada Gazette, Part II between January and June 2024.

As the amendments are being finalized, ECCC cannot commit to providing a minimum of 12 months lead time to enforce the prohibitions once the final amendment is published.  The Ministry does comprehend and acknowledge the need for a reasonable delay to allow for the industry to adapt to the new requirements.

We encourage members to share this notice with their channel partners.
